Geomet appealed from a decision granting exclusive possession of certain unpatented mining claims to Lucky Mc Uranium Corporation. The Court of Appeals affirmed, 124 Ariz. 60, 601 P.2d 1344 (App.1979). Geomet petitioned for review and we granted review under A.R.S. ç 12-120.24 and Rule 23 of the Rules of Civil Appellate Procedure. We now vacate the opinion of the Court of Appeals.
